Area of application

The following General Terms and Conditions exclusively apply to orders placed with the online shop called “product of the day” (Otherwise known as POTD). By placing an order with POTD you are deemed to have understood and accepted these terms. If required, you can download and print the text.

 

Contract Terms

Our product descriptions and prices stated during the order process are subject to confirmation and non-binding.

 

You submit a binding offer to POTD when you have passed the order process, stating all details required and have clicked on the button "Pay Now". 

 

Having processed your order, we shall send you an email confirming the receipt of your order and listing all relevant details (Order confirmation). This order confirmation does not represent an acceptance of your order; it just serves the purpose of informing you that we have received your order. We reserve the right to refuse to accept an order in whole or in part. 

 

All orders are treated as placed and received in the United Kingdom and all contracts for the sale of goods are subject to the law in England and subject to the exclusive jurisdiction of the English courts. A contract of sale is only concluded when we accept your order by supplying the goods. You can track the status of your order in "My account" under "Your orders". The minimum age for placing an order at the online shop is 18.

Storage of your order details

Your order details are stored on the POTD website. If you require a hard copy, you can print the "Order confirmation". This will appear on your screen once you submitted your order. If you have provided us with your email address, you will in addition receive all relevant data of your order by email, which you can also print out.

 

Delivery & Costs

Deliveries are carried out by our shipping partners (Mon to Sat) exclusively to delivery addresses within the UK (excluding the Scilly Isles & Channel Islands) and the Isle of Man. POTD endeavours to dispatch orders as soon as possible. All orders are despatched within five working days from the end of the day the order is placed. We are unable to commit to when an order will be delivered due to the number of external factors which can affect this.

 

Delivery costs are shown as a separate line on the order summary.

Payments

Payments can be made by credit/ debit card (Visa, MasterCard), or PayPal. All prices are stated in GB Pounds, including the statutory VAT currently at 20%. The prices valid at the time of placing the order shall apply. All products supplied remain the property of POTD until they have been paid in full.

 

Warranty/Guarantee

If the goods received are damaged or defective, POTD will at our own option replace, repair or refund the amount originally paid for them. This can be done following the returns process on the website by logging into your account and returning the goods via the Royal Mail or any delivery company of your choice.

 

Cancellation policy

POTD offers customers the facility to exchange goods or obtain a refund, which is in addition to your legal rights. The only conditions are that the goods are in a new and unworn condition, in their original packaging, that the customer provides a proof of purchase and they are returned to us within 7 days of receipt.

 

Cancellation Rights

Under Distance Selling Regulations, you may cancel your contract with us within 8 days without having to specify any reasons. This can be done either in writing (e.g., email (to [email protected]) or letter) or by returning the goods. The period begins on the later of the date of receipt of these cancellation rights or the date the customer received the goods (in case of recurring deliveries of the same type of goods the date of receiving the first partial delivery). Goods can be returned to POTD via Royal Mail or a carrier of your choice.

 

Consequences of cancellation

In the event of an effective cancellation, any contributions received by either party must be returned and, where applicable, any benefits received (e.g., interest) are to be surrendered. If you are not able to return all or part of the goods or only in deteriorated condition, you are obliged to reimburse us with the respective value. 

 

This shall not apply in the event that the deterioration of the surrendered goods is due to the inspection of the goods as it would have been possible in a shop. However, you may avoid any duty to provide compensation for any deterioration of the goods caused by the intended use, by not using the goods as your own property and refraining from all actions that may affect their value. Obligations to refund payments must be met within 30 days of the customer notifying us of their wish to cancel.

 

Complaints/mediation

The UK government provides an online dispute resolution service. This enables consumers to resolve disputes about online transactions without having to go to a court. Severability Clause

Should any of the provisions of these General Terms and Conditions be or become ineffective, the statutory provisions will apply instead of the ineffective provision. This will not affect the validity and enforceability of the remaining provisions.
